TERMS AND CONDITIONS OF ENTRY | DEMAND DUO USER GENERATED CONTENT

This competition commences at 9:00 am, Thursday 13 August 2020 and ends at 5:00 pm, Thursday 5 November 2020. Finalists will be announced fortnightly on Fridays at 3pm (28 August, 11 September, 25 September, 9 October, 23 October, 6 November) and the winner will be announced at 3pm on Monday 9 November.

1. Eligibility Requirements & Competition Period
1.1. Information on how to enter and the Prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
1.2. Entry is open to all ABN registered pest control businesses in Australia and entrants representing that business as an ‘entrant’ must be over the age of 18 years old (the ‘Entrant’).
1.3. Employees of the Promoter, including all staff, and their immediate families (including spouse, ex-spouse, de-facto, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, bother, sister, step-brother, step-sister or cousin) and associated agencies, providers and companies of the Promoter associated with this Competition are not eligible to enter. 
1.4. Entrants can only enter the Competition in their own name and the name of their registered Australian pest control business or employer. The Promoter reserves the right to verify the validity of entries and Entrants (including age and place of residence) and to disqualify any Entrant who submits an Entry that is not in accordance with these Terms and Conditions or if the Entrant is engaged in any unlawful of other improper conduct which jeopardises the proper conduct of the Competition. The Promoter’s legal right to recover damages or other compensation in such instances is reserved. If the Promoter suffers loss or incurs any costs in connection with any breach of the Terms and Conditions or any other legal obligation of the Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.
1.5. The Competition commences at 9:00 am (AEST), on Thursday 13 August 2020 and entries close at 5:00 pm (AEST), on Thursday 5 November 2020 (the ‘Competition Period’).

2. How to Enter
2.1. To enter the Competition, an Entrant must, during the Competition Period share their experience using Demand Duo by uploading a video or picture to either their pest control company’s Facebook page or the Syngenta PPM Facebook page, and tag Syngenta (@Syngenta.PPM.ANZ) and use the hashtag #DemandDuo. By submitting an entry, an individual warrants that they have the consent and authority of the business who will be the entrant and consents to being contacted by the Promoter for marketing purposes electronically for an unlimited period.
2.2. Entrants can enter directly on Facebook as outlined in 2.1 or by emailing their video or photograph to syngentapmp.au@gmail.com to be posted to https://www.facebook.com/syngenta.ppm.anz on behalf of the entrant.
2.3. It is the sole responsibility of the entrant to seek all permissions related to any content submitted. The Promoter takes no responsibility in images or videos used that are copyright or of another individual where permission was not sought.
2.4. Entrants will be contacted by the Promoter to confirm their name, name of pest control business they represent or are employed by and their email address.
2.5. This is a game of skill with the winner selected at the judge’s discretion.
2.6. The Promoter reserves the right to re-use all competition entries on their Facebook channel and website.
2.7. All entries that are incomplete, illegible, damaged, contain inappropriate or offensive content, or do not conform to or satisfy any condition of the rules may be disqualified by the Promoter at its sole discretion

3. The Winner
3.1. Following the conclusion of the competition on the Closing Date, the Promoter will select the most relevant entry as the winner. The judging will take place at the offices of Syngenta Australia Pty Ltd. Level 1, 2-4 Lyonpark Rd, Macquarie Park, NSW 2113, Australia. The winning entry will be notified via email.
3.2. Finalists will be announced each fortnight (28 August, 11 September, 25 September, 9 October, 23 October, 6 November), with the winner announced on Monday 9 November. Each finalist will receive a bottle of Demand Duo Insecticide, and the competition winner will receive $1000.00 cash. 
3.3. The Promoter reserves the right to select a single or multiple Finalists for each fortnight period.
3.4. The Promoter reserves the right to select a winner from any of the entries to the competition.
3.5. If any Prize is unclaimed or if the Promoter is unable to verify the Winner (in the Promoter’s absolute discretion), then the Promoter may conduct such further selection as are necessary to determine a new winner any time not sooner than 90 days after the initial Date of Notice. 

4. Facebook
4.1.  Entry and continued participation in the Competition is dependent on the Entrant following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
4.2.  This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information any Entrant provides will only be used for the purposes outlined in the Terms and Conditions. Any questions, comments or complaints about this Competition must be directed to the Promoter and not to Facebook. 
4.3. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an Entrant, as a result of participating in the Competition except for any liability which cannot be excluded by law.

5. Privacy
5.1. The Promoter’s privacy policy can be read at https://www.syngentappm.com.au/privacy-statement.
5.2. Any personal information collected from the Entrant will be used by the Promoter for direct marketing purposes only and will not be disclosed or on-sold to other promoters.
5.3.  By submitting your Entry into this Competition, you are accepting the terms and conditions herein and you are expressly consenting to the Promoter using your personal information to send to you any direct marketing by any method available to the Promoter. 
5.4. The Winner agrees to the winning and prize fulfilment process being filmed and photographed, to be used for marketing and promotional purposes by the Promoter.

6. How to Unsubscribe
6.1. If you want to stop receiving direct marketing from the Promoter you can communicate this to the Promoter by: (a) selecting the ‘unsubscribe’ hyperlink on the Promoter’s marketing material and following any prompts; or (b) sending an email to syngenta.info@syngenta.com

7. General
7.1.  All Entrant’s irrevocably agree to have their name and photograph used for advertising purposes and/or to take part in promotional activities including, without limitation, being interviewed by television, radio and/or other mediums for public broadcast free of any payment (if required by the Promoter). 
7.2. The Promoter may, at any time but subject to State and Territory legislation, amend, add to or delete any of these Terms and Conditions.
7.3. The Promoter’s decision is final and no correspondence will be entered into. The Prize will only be awarded following any Winner validation and verification that the Promoter requires. 
7.4. The Promoter, subject to State and Territory legislation, reserves the right, at any time, to verify the validity of Prize claims / Entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who submits a Prize claim that is not in accordance with these Terms and Conditions or who tampers with the Entry process. Subject to State and Territory legislation, Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 
7.5. If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant. If the Winner cannot be identified or otherwise contacted by the Promoter, the Promoter reserves the right to select another Entrant as the Winner. 
7.6.  Entrants consent to the Promoter using their Entry and agree to transfer all intellectual property in their Entry to the Promoter once an Entry is made.
7.7. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the control of the Promoter, the Promoter reserves the right, subject to subject to State and Territory legislation: (a) disqualify any Entrant; or (b) to modify, suspend, extend, terminate or cancel the Competition.
7.8. The Winner must be a registered Australian pest control business within Australia. If requested by the Promoter a registered ABN must be supplied by the winner to claim the prize.
7.9.  Nothing in the Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under similar consumer protection laws.
7.10.  Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees, agents and related bodies corporate) is not responsible for and excludes all liability (including negligence) for any personal injury, or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the control of the Promoter; (d) any tax liability incurred by the Winner or any Entrant; or (e) taking of and redemption of the Prize.
7.11. The laws of Australia apply to this Competition. Entrants submit to the exclusive jurisdiction of the courts of Australia.
